1. Health and Wellness Information
You are responsible for your own health. Pulse Now is not a medical organization, and we do not provide medical advice, diagnosis, or treatment.
Non-Medical Device: The heart rate monitoring and health indicators provided in this application are for informational purposes only. They are not a substitute for professional medical equipment or the advice of a doctor.
Consult Your Doctor: Always consult with a qualified healthcare professional before starting any fitness program, changing your diet, or if you have a pre-existing heart condition. If you experience any pain, dizziness, or discomfort while using the App or exercising, stop immediately and seek medical attention.
No Guarantees: Pulse Now cannot guarantee any specific health or fitness results. We are not responsible for any personal injury or damages resulting from the use or misuse of the Services.
2. Eligibility and Children
Our Services are intended for use by healthy adults. By using Pulse Now, you affirm that:
- You are at least 13 years of age (or the minimum legal age in your country).
- If you are between the ages of 13 and 18, you are using the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
- You do not suffer from any medical condition that may be impaired by physical activity or fitness tracking.
3. Subscriptions
(1) General: The App is available for download on a free basis. However, "Premium" features require a paid subscription.
(2) Billing: Paid subscriptions are billed via the Apple In-App Purchase system. You authorize Apple and Pulse Now to charge the applicable fees to your linked payment method.
(3) Trials: Some subscriptions may include a "Trial" period. Unless you cancel at least 24 hours before the end of the Trial, you will be automatically charged the full subscription price. It is your responsibility to manage Trial timelines.
(4) Renewal and Cancellation: Subscriptions renew automatically. To avoid being charged for the next period, you must affirmatively cancel the subscription in your Apple ID Settings at least 24 hours before the current period or trial ends.
(5) Price Changes: We reserve the right to adjust pricing. Any changes will take effect at the start of the next billing cycle. Continued use of the Service after a price change constitutes acceptance.
4. Third-Party Resources
Our Services may link to third-party websites or resources. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge sole responsibility for all risks arising from your use of such resources.
5. Changes to This Agreement
We reserve the right to modify this Agreement at any time. We will notify you of material changes via the App or by updating the "Last Updated" date. Your continued use of Pulse Now after such changes constitutes your acceptance of the new Terms.
6. Termination
We reserve the right to terminate your access to the Service at our sole discretion, without notice, for any reason—including a breach of these Terms. Upon termination, your right to use the App ceases immediately.
